Marital Property Division in Fairfield County, CT Divorce

Westport Divorce and Asset Protection Attorney

When a couple cannot reach a property settlement during a divorce, the court will determine the division of the marital assets according to Connecticut law. In most cases, leaving the decision up to a judge is not the best option; you may increase your chances of receiving your fair share of the assets if you work with and follow the advice of an experienced divorce lawyer.

I represent husbands and wives in divorce proceedings. Because I have been practicing family law for more than 30 years, I can take on any divorce case, no matter how contentious or complex. To discuss your divorce, please call the law office of Richard H. Raphael at 203-226-6168 or contact me online to schedule an appointment. Your initial consultation is free.

How Property Is Divided

Marital property is subject to equitable distribution, which does not necessarily mean the marital property will be divided equally between each person. Instead, the court strives for a distribution that it considers fair. In Connecticut, equitable distribution is based on several statutory factors, including:

  • Length of the marriage
  • Health and age of each party
  • Contributions each party made to the marriage
  • The income of each party
  • Earning capacity of each party
  • Marital fault

The couple's marital assets and debts must be inventoried, valued and then divided. I can assist you with all of your marital estate, including:

  • Personal property (such as vehicles, furniture, art and jewelry)
  • Real estate
  • Financial accounts
  • Retirement accounts
  • Family businesses
  • Insurance policies
  • Mortgages and other loans
  • Credit card debt
  • Taxes
  • Injury or other judgments against you
